DroneControl Global Terms and Conditions
These Global Terms and Conditions (“Terms”) govern your access to and use of the DroneControl ecosystem, including the DroneControl web portal and the DroneControl FirstResponder mobile application (“Services”). These Terms apply to all users of the Services, whether an organizational client (e.g. agency or company) or an individual pilot (“User” or “you”). By registering for a DroneControl account and clicking “I Agree,” you confirm that you have read, understood, and agree to be bound by these Terms. If you are accepting on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree with these Terms, you must not use the Services.
1. Definitions
For purposes of this Agreement, the following terms have the meanings given below:

“DroneControl” (also “we” or “us”) refers to DroneControl SA, a company registered in Switzerland (CHE-300.070.628), with its principal address at Route de la Galaise 34, CH-1228 Plan-les-Ouates, Geneva, Switzerland.

“Services” means the DroneControl software ecosystem, including the web-based portal, the DroneControl FirstResponder mobile app, and all related software, features, and services provided by DroneControl.

“User” or “you” means any person or legal entity that registers for or uses the Services. This includes individual pilots as well as organizational clients and their authorized personnel (pilots, administrators, etc.).

“DJI” refers to SZ DJI Technology Co., Ltd. (“DJI”) – the manufacturer of drone hardware with which the DroneControl platform integrates. “DJI MSDK” means DJI’s Mobile Software Development Kit, which DroneControl utilizes for hardware integration.

“Personal Data” means any information relating to an identified or identifiable natural person (data subject) and “Processing” means any operation performed on Personal Data, as defined under the EU/UK General Data Protection Regulation (GDPR). “Controller” and “Processor” have the meanings given in GDPR (generally, the Controller determines the purposes and means of processing personal data, and the Processor processes data on the Controller’s behalf).

“Controller’s Data” means any data, including Personal Data, that you (as a Controller) provide to DroneControl for processing on your behalf. For individual Users, your personal information and flight data are also treated in accordance with our Privacy Policy (where DroneControl may act as a controller of that data).

“Confidential Information” means non-public information that is proprietary or confidential to a party, including business information, technical data, and Customer Data, as well as any information that a reasonable person would understand to be confidential due to its nature or the circumstances of disclosure.

“DroneControl Data Processing Contract (DPC)” means a separate data processing agreement that may be executed between DroneControl and an organizational client, outlining each party’s GDPR obligations. (For organizational clients, the DPC is incorporated by reference and supplements these Terms regarding data protection.)
Other capitalized terms may be defined elsewhere in these Terms or in the DroneControl DPC.
2. Scope of Services
2.1 Services Description: DroneControl provides a software platform enabling secure remote drone operations and fleet management. The Services include features such as live drone video streaming, remote control delegation, pilot geolocation tracking, automated flight log uploads, secure media storage, and regulatory compliance tools. The DroneControl FirstResponder mobile app allows pilots to control DJI enterprise drones using DroneControl’s interface (built on DJI’s official SDK), while the DroneControl web portal allows command centers and authorized remote users to view live streams, assume control (with permission), and manage operational data. The Services are designed for professional use (e.g. emergency response, law enforcement, firefighting, and other enterprise drone operations) but are available to any authorized User meeting the eligibility requirements herein.
2.2 Platform Integration with DJI: DroneControl’s software is built entirely on DJI’s official Mobile SDK, ensuring deep integration with DJI drone hardware. By using the DJI MSDK, DroneControl generates DJI-encrypted .DAT flight logs for every mission. These logs are part of DJI’s diagnostic process, helping determine root causes of hardware incidents and facilitating warranty evaluations. Important: DroneControl is independent of DJI; while we integrate with DJI products, we are not an affiliate, agent, or insurer of DJI. Use of DJI hardware is subject to DJI’s own terms and warranties (see Section 9 below for warranty details). DroneControl does not supply the drone hardware, and you are responsible for procuring and maintaining your drones and any required hardware.
2.3 Updates and Changes: DroneControl may update the Services (e.g. to add new features, enhance security, or comply with legal requirements). We reserve the right to modify or discontinue parts of the Services at any time. We will endeavor to notify Users of material changes (for example, via portal notification or email). Continued use of the Services after any update signifies your acceptance of the Services as modified. We may also update these Terms from time to time (see Section 17).
3. User Accounts and Eligibility
3.1 Account Registration: To access the Services, you must create a DroneControl account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. Each individual User must have unique login credentials; shared or generic accounts are not permitted. For organizational clients, each pilot or administrator should have their own user account. Access Credentials: You are responsible for maintaining the confidentiality of your login credentials (username, password, API keys, etc.) and for all activities that occur under your account. You must promptly notify DroneControl of any suspected unauthorized access or breach of your account’s security.
3.2 User Eligibility: You represent that you are legally permitted to operate drones and use the Services in your jurisdiction. If you are an individual, you must be at least the legal age of majority in your country (and at least 18 years old) and hold any required pilot certifications or licenses. If you are using the Services on behalf of an organization, you confirm that you are an authorized representative of that organization with the authority to bind the organization to these Terms, and that the organization and its users meet any legal requirements for drone operations.
3.3 Account Use: You agree to use your account solely for your internal business or personal operational purposes (as applicable) and not to impersonate any other person or entity. You will not transfer your account to any third party without DroneControl’s written consent, and you will not share your password or access tokens with unauthorized persons. DroneControl is not liable for any loss or damage arising from your failure to comply with these account security obligations.
4. Acceptable Use Policy
By using DroneControl, you agree to adhere to the following acceptable use rules. You shall not:

Illegal Activities: Use the Services for any unlawful, illegal, or prohibited purpose. This includes (but is not limited to) using a drone in a manner that violates local, regional, or international laws and regulations (such as aviation regulations, privacy laws, or export control laws). You must not use DroneControl to surveil individuals or property in violation of privacy rights or to carry any illegal payloads or contraband.

Interference and Hazardous Use: Operate a drone via the Services in a reckless or unsafe manner. You may not interfere with other aircraft, invade restricted airspace, or ignore applicable flight restrictions and Notices to Airmen (NOTAMs). The Services may include airspace data and geofence alerts to assist with compliance, but you remain responsible for safely piloting the drone and complying with all airspace rules. Do not use the platform to attempt beyond-visual-line-of-sight (BVLOS) operations or other advanced operations unless you have the required regulatory approvals.

Unauthorized Access and Security Violations: Attempt to gain unauthorized access to the Services or DroneControl’s systems, or bypass or disable any security or authentication measures. You shall not probe, scan, or test the vulnerability of any system or network of DroneControl, nor breach or circumvent any security or encryption measures used by the Services. Additionally, you must not introduce any malware, viruses, worms, Trojan horses, or other harmful code into the Services. DroneControl maintains an anti-malware policy and employs real-time scanning and regular patch management to protect the platform – you must not willfully undermine these protective measures.

Civil Use - Users hereby acknowledges and agrees that the software provided by DroneControl SARL shall only be utilised for civil use. The software shall not, under any circumstances, be used, sold or distributed for military purposes unless explicit authorization is obtained from DroneControl SARL. Users understands that any unauthorized use of the software for military use may result in legal action and termination of the licensing agreement. By entering into this agreement, the user agrees to adhere to this clause and to ensure compliance with all applicable laws and regulations pertaining to the use and distribution of the software.

Misuse and Disruption: You shall not misuse the Services in a way that could impair the functionality of the platform or interfere with other users’ use. This includes no launching of any automated system that sends excessive requests to the platform, no denial-of-service attacks, and no actions that could impose an unreasonable load on the infrastructure. You may not use the communication features (e.g. live video, two-way audio, or messaging) to harass, threaten, or harm any person.

Prohibited Content: When using features that involve audio/video streaming or data upload, you must not transmit or store content that is obscene, defamatory, infringing, or otherwise objectionable or unlawful. You are responsible for any content (including live video or recordings) that you capture and share via DroneControl. DroneControl may remove or restrict access to any content that violates this policy or applicable law.

Reverse Engineering and Competitive Use: You shall not reverse engineer, decompile, or disassemble the DroneControl software or attempt to derive the source code or underlying ideas or algorithms of any component of the Services (except as permitted by law). You shall not use the Services to develop or enhance any competing platform. Using any portion of the Services for the purpose of creating a competing product or service or for benchmarking without consent is prohibited.
DroneControl reserves the right to monitor compliance with this Acceptable Use Policy and to suspend or terminate accounts for any violation (see Section 14). Serious violations may also be reported to law enforcement or regulators where appropriate.
5. User Responsibilities and Safety Compliance
5.1 Compliance with Laws: You represent and warrant that you are in compliance with, and will continue to comply with, all applicable laws, regulations, and ordinances related to your use of drones and the Services. Licenses and Permits: You have and will maintain all required licenses, permissions, authorizations, consents, and permits needed to operate drones and use the Services safely and legally. This includes (where applicable) drone operator certificates, remote pilot licenses, registrations of drones with aviation authorities, and any operational waivers or exemptions required for your flight missions. You also agree to comply with all operating instructions, user manuals, safety guidelines, and training materials provided by DroneControl or by the drone manufacturer when using the Services.
5.2 Organizational Use: If you are an organization, you are responsible for ensuring that all individual end-users (pilots, operators, administrators) who access the Services under your account or license comply with these Terms. You must supervise and be liable for the actions of your personnel. You should implement your own internal policies to ensure your pilots operate drones within the authority you have (e.g. for public safety agencies, ensure flights are authorized and logged according to your internal protocols). DroneControl provides tools such as centralized mission planning, checklists, risk assessments, and compliance reporting to assist you, but these do not absolve you of oversight responsibilities.
5.3 Flight Safety: Pre-Flight – You are responsible for conducting all necessary pre-flight safety checks. DroneControl’s platform may assist with pre-flight workflows (e.g. digital checklists, risk assessments, and real-time airspace/NOTAM integration), but final verification of airworthiness, weather conditions, and regulatory compliance before takeoff rests with you. During Flight – Always operate with due regard for safety of persons and property. If you delegate control to a remote user (see Section 8.2), it is your responsibility to ensure that remote operator is qualified and that conditions are safe for remote operation. Post-Flight – Ensure compliance with any post-flight requirements (such as recording flight details in logbooks if not automated, reporting incidents to authorities, etc.). DroneControl automatically uploads flight telemetry and logs to assist with record-keeping, and provides tools for generating compliance reports, but you must review and use this data appropriately to fulfill your obligations under aviation rules.
5.4 No Emergency Services Guarantee: While DroneControl is often used in emergency response scenarios, you acknowledge that the Services are not guaranteed to be available or error-free during critical operations. You must have any necessary backup plans. No Real-Time Guarantee: There may be slight delays in video or data transfer; DroneControl strives for ultra-low latency (under 200ms for video) but network conditions can vary. You accept that you will not rely solely on the Service for life-critical decisions without verifying information through multiple sources if possible.
5.5 User Equipment: You are responsible for procuring and maintaining all equipment necessary to operate the Services, including compatible DJI drones, remote controllers, mobile devices running the FirstResponder app, and internet connectivity. You must ensure your devices meet any minimum requirements and are kept up-to-date with the latest security patches and DroneControl app versions. You should enable and use appropriate security (e.g. device PINs/passwords, not jailbreaking devices, using VPN where required) on your equipment consistent with DroneControl’s recommendations and cybersecurity best practices. If you use any non-DJI drones or hardware with DroneControl (to the extent the Service supports them), you are responsible for any compatibility or safety issues — DroneControl primarily supports DJI enterprise drones via the DJI MSDK.
6. Insurance Requirements
Because drone operations carry inherent risks, you must maintain appropriate insurance coverage for your activities. During the term of use of the Services and as long as you operate drones with DroneControl, you agree to carry sufficient insurance to cover your drone operations and any associated liabilities. This insurance should include at minimum any third-party liability coverage required by law in your jurisdiction (for example, EU users must have UAV liability insurance in compliance with EU regulations, and many countries mandate minimum coverage for drone operations). It is strongly recommended that you also carry hull insurance for your drones to cover damage to your equipment.

Insurance for Organizations: If you are an organization or enterprise, you shall maintain commercially reasonable levels of insurance for your drone operations, listing DroneControl (and its affiliates, officers, and agents) as additional insureds where feasible. You agree to provide a certificate of insurance as evidence of coverage upon DroneControl’s request. Except where prohibited by law, your insurance policy should waive subrogation rights against DroneControl for any claims related to the use of the Services.

Insurance for Individuals: If you are an individual pilot, you confirm that you either have appropriate personal drone liability insurance or acknowledge that you solely assume all risk of operating without insurance. DroneControl does not provide any insurance or protection plan to Users, and by using the Services you understand that DroneControl is not an insurer or liable for any damages or losses resulting from your drone operations.
DroneControl’s No-Insurance Clause: DroneControl’s provision of the Services is not a substitute for insurance. We do not provide liability insurance or damage coverage for User operations, and we will not pay for losses that would ordinarily be covered by a drone insurance policy. All claims or damages arising from drone flights (including personal injury, property damage, or regulatory fines) must be covered by your own insurance or out-of-pocket by you. In no event will DroneControl be responsible for such operational losses. Your obligation to maintain insurance is a material requirement of these Terms, and failure to do so is at your own risk and shall not reduce any disclaimers or limitations of DroneControl’s liability herein.
7. Platform Features and Specific Terms of Use
The DroneControl platform offers various features to enhance remote drone operations. The following provisions describe key features and any additional terms or clarifications for their use:
7.1 Live Video Streaming: DroneControl enables real-time encrypted video streaming from your drone’s camera to authorized viewers. The streaming is conducted via peer-to-peer connections using Web Real-Time Communication (WebRTC) technology, and it is end-to-end encrypted so that only intended recipients can view the live video. By using the live streaming feature, you consent to DroneControl’s temporary processing and relay of video data for the purpose of delivering the stream. We do not actively monitor the content of streams, but we may record or store streams if you activate recording or evidence collection features (see 7.6 below). User Responsibilities: You are responsible for who you share the stream with. The platform allows you to share live stream access via secure links or dynamic QR codes; you must only share such access with trusted, authorized personnel. You must not broadcast sensitive footage to unauthorized persons. DroneControl is not liable for any consequences of your decision to share (or not share) live streams. Note that network connectivity is required for streaming; DroneControl may use TURN servers as a fallback to maintain the connection, but quality can vary with bandwidth.
7.2 Remote Control Delegation: A unique feature of DroneControl is the ability to delegate remote control of the drone or its payload to another authorized User over the network. For example, a remote commander can take control of the drone’s gimbal (camera orientation), camera zoom, and even pilot the drone itself if needed – all through an encrypted channel with minimal lag. This feature greatly aids collaboration (e.g. a pilot on scene can hand over control to an off-site expert). User Responsibilities: Remote control should only be given to qualified operators. By allowing remote control, you acknowledge that the remote User’s actions (while they have control) are still your responsibility and are considered as if performed by you. Ensure that any person you delegate control to is properly trained and legally permitted to operate the drone. Two-Way Communication: The platform includes integrated two-way audio between on-site pilots and remote controllers to coordinate during incidents. All users must use this capability lawfully and professionally. Miscommunications or misunderstandings during remote ops can be hazardous; DroneControl is not responsible for any mishap or damage resulting from remote pilot error or communication issues. We log remote control sessions (who took control and when) for audit and safety purposes. You should always be prepared to retake manual control if needed.
7.3 Pilot Tracking and Geolocation: DroneControl may collect and display the real-time geolocation of the on-site pilot’s controller or device for situational awareness. For instance, the system can translate GPS coordinates into human-readable addresses using mapping tools (e.g. what3words, Mapbox) so that command centers know where the pilot and drone are operating. By using the FirstResponder app and the Services, you consent to this location tracking for operational purposes. DroneControl uses this data to enhance coordination among team members and provide context to the drone’s video feed (e.g. showing the pilot’s location on a map). Privacy: We handle pilot location data as Personal Data under our Privacy Policy. Location tracking is only active during missions and training sessions; we do not track your location continuously when the app is inactive. User Responsibilities: You must ensure that any individuals whose location is being tracked (e.g. pilots or vehicles) are informed and have consented if required by law. Do not misuse location data – it should only be used for operational coordination and safety.
7.4 Flight Log Uploads and Data Sync: After each flight, DroneControl automatically syncs flight logs, telemetry data, and equipment usage information to the secure cloud portal. Key flight parameters (route flown, altitudes, battery levels, etc.) are stored to assist with compliance, post-mission review, and maintenance tracking. This automation removes the need for manual data offloading and helps ensure that flight records are complete and tamper-evident. By using the Services, you agree that DroneControl will collect and store these flight logs and related data on your behalf. Data Use: Flight log data is used to provide you with dashboards and reports, to support regulatory compliance (Section 7.5), and to feed into fleet maintenance tools (e.g. tracking battery cycles and drone component health). DroneControl does not share your flight logs with any third party except as needed to provide the Service (for example, uploading encrypted logs to DJI as part of diagnostics or warranty claims – see Section 9) or as required by law. User Responsibilities: You are responsible for reviewing your flight logs and complying with any regulatory record-keeping requirements. DroneControl’s storage of logs is a convenience and should not be your sole backup – always consider maintaining your own copies if required by internal policy. If you request deletion of certain logs (per Data Protection terms), we will comply as far as legally and operationally practicable, after which you will be responsible for any retained records.
7.5 Regulatory Compliance Tools: DroneControl is designed to assist Users in meeting their regulatory obligations. The platform integrates real-time airspace data and NOTAM alerts to warn pilots of restricted zones and help ensure flight plans comply with aviation regulations. It can automatically generate standard flight logbook entries and incident reports, exportable in common formats (CSV, PDF). Built-in tools support filing compliance reports and post-flight debrief forms aligned with organizational policies. Disclaimer: While DroneControl provides these tools, ultimate responsibility for regulatory compliance lies with you as the operator. DroneControl does not guarantee that use of the Services will fulfil all legal requirements applicable to your drone operations. For example, if a law requires you to manually file a report with authorities, DroneControl may help compile the data but you must still file it. Always verify that automatically generated reports are accurate and complete. Updates: Regulatory data (like airspace maps or rules databases) may not always be up-to-the-minute; DroneControl relies on third-party data sources and strives to keep them updated. Use your judgment and double-check critical information with official sources if needed. By using these tools, you agree that they are provided “as-is” to assist you and that DroneControl is not providing legal advice or certifying compliance.
7.6 Secure Media Storage and Evidence Management: The Services include options for secure storage of photos, videos, and other media captured during flights. You can configure DroneControl to automatically upload media to a cloud repository (DroneControl’s cloud or your own servers) after or during a flight. Media uploads are encrypted using AES-256 encryption for data at rest and are subject to role-based access controls so that only authorized personnel can retrieve or view them. DroneControl’s evidence management features are designed for law enforcement and emergency services use: for example, the system can buffer a short video cache so that if an incident occurs, footage from a few minutes before the “record” button was pressed is still available (to capture lead-up events). Chain-of-Custody: Uploaded media is stored with integrity checks to preserve chain-of-custody, meaning that if a drone or SD card is lost or damaged, an authoritative copy of the imagery still exists on the secure server. User Responsibilities: If you use these features, you are entrusting DroneControl with potentially sensitive media. We will treat such media as Confidential and will not access or disclose it except to provide the Service or as legally compelled. You are responsible for managing access rights (e.g. revoking a user’s access if they leave your organization). You should download and appropriately archive any media that must be retained long-term for evidentiary or compliance reasons, in accordance with your own policies. DroneControl’s cloud is intended as operational storage, not permanent archival for all time (see Data Retention in Section 12).
8. Data Protection and Privacy
8.1 GDPR and Global Privacy Compliance: DroneControl is committed to protecting personal data in accordance with the EU/UK GDPR and similar data protection laws worldwide. If you are an organizational client, DroneControl acts as a Data Processor processing personal data on your behalf, and you (and/or your organization) remain the Data Controller for any personal data submitted to the Services. Controllership of your data remains with you at all times. If you are an individual end-user using DroneControl for personal or independent purposes, DroneControl will be the controller of any personal data you provide (such as your account information and telemetry data linked to you), and our Privacy Policy will govern how we handle that data. In either case, personal data will be processed lawfully, fairly, and in a transparent manner and only for the purposes of providing and improving the Services, as well as complying with our legal obligations. We do not collect more data than necessary (data minimization), and we limit use of personal data to the stated purposes (purpose limitation). Special categories of personal data (e.g. biometric data, health data) are not intentionally processed by DroneControl, and you agree not to intentionally upload any sensitive personal data to the platform unless it is necessary for operational use and you have the appropriate legal basis to do so (for example, do not upload personal medical info or racial/ethnic data about individuals into mission notes, etc., unless required and lawful).
8.2 Data Processing Contract (DPA): If you are an organizational client, a separate Data Processing Contract or Data Processing Addendum (“DPA”) may apply to define roles and responsibilities under GDPR and similar laws. That DPA is hereby incorporated by reference. Among other things, the DPA confirms that (a) you are the Controller and DroneControl is your Processor; (b) DroneControl will only process personal data on your documented instructions and for the purposes of providing the Services (except as otherwise required by law); (c) DroneControl will implement appropriate technical and organizational measures to protect personal data (see Section 10, Security); (d) DroneControl will assist you in fulfilling your obligations to respond to data subject requests or incident notifications, as reasonably required; and (e) DroneControl will delete or return personal data at the end of the engagement, subject to Section 12 (Data Retention) below. In the event of any conflict between the DPA and these Terms regarding data protection matters, the DPA will prevail for those matters. If you have not separately executed a DPA and require one (for example, if you are subject to GDPR as a Controller), please contact DroneControl to put one in place.
8.3 Personal Data in the Services: Personal data processed through the Services may include, for example, user account information (names, contact details, credentials), pilot location data (as described in Section 7.3), and any personal data that may incidentally appear in drone footage or logs (e.g. images of people on the ground captured by the drone camera). Your Obligations: You confirm that any personal data you input or allow to be captured via the Services is done so in compliance with applicable data protection laws – for instance, if you film individuals, you have either obtained any necessary consents or have another lawful basis for processing. You will not use the Services to collect or share personal data in a way that violates privacy rights. If you are an organization, you are responsible for providing appropriate privacy notices to data subjects (e.g. informing employees or members of the public as required) regarding the data processing activities involving DroneControl. You must also honor data subject rights requests pertaining to data in the platform; DroneControl will assist you by providing tools or data exports as needed.
8.4 DroneControl’s Data Protection Measures: We implement and maintain appropriate technical and organizational measures (“Protective Measures”) to ensure a level of security appropriate to the risk of the personal data we process. These measures include pseudonymization and encryption of Personal Data where feasible, ensuring the ongoing confidentiality, integrity, availability, and resilience of our systems and services, the ability to restore access to data in a timely manner in the event of an incident, and regular testing and assessment of our security measures. Concretely, DroneControl uses strong encryption for data at rest and in transit (see Section 10.2), role-based access controls, audit logs, and other safeguards as outlined in our Cybersecurity White Paper. We ensure that by default data stays within the region designated by the customer and is not transferred internationally without proper safeguards (for example, EU customer data is stored in EU data centers unless otherwise authorized). We also ensure that any subprocessors (e.g. our cloud hosting provider) maintain high standards of security and compliance (AWS data centers hold ISO 27001, SOC 2, PCI-DSS, etc., and comply with GDPR requirements). DroneControl employees and contractors are bound by confidentiality obligations and receive training in data protection. For more details on our measures, you may refer to our Security & Data Protection White Paper.
8.5 Data Subject Rights: To the extent required by law, DroneControl will assist data subjects in exercising their rights (access, rectification, erasure, restriction, objection, data portability, etc.). If you are an individual user, you can request access to or deletion of your personal data held by DroneControl by contacting us as specified in our Privacy Policy. If you are an organizational client’s data subject (e.g. an employee pilot or someone appearing in drone footage), requests may be routed through the Controller (your organization), but DroneControl will cooperate in good faith to fulfill legitimate requests. Note that certain data may not be erasable if DroneControl is required to retain it by law or if it has been anonymized. We will inform you of any such limitations if applicable.
8.6 Privacy Policy: Additional details about how DroneControl collects, uses, and discloses personal information are available in our Privacy Policy (available on our website). The Privacy Policy is hereby incorporated by reference into these Terms for individual Users where DroneControl is a data controller. If any discrepancy exists between these Terms and the Privacy Policy as to personal data handling, these Terms will govern usage of the Services, and the Privacy Policy will govern general data handling not specifically described here.
9. Security Measures and Incident Response
DroneControl maintains a robust cybersecurity program to protect the Services and User data. By using the Services, you acknowledge and accept the following security provisions and agree to also uphold certain security practices on your side:
9.1 Access Control: DroneControl enforces an Access Control Policy to restrict system access to authorized individuals on a least privilege basis. All DroneControl personnel and contractors have unique user IDs, and access rights are granted based on job necessity. Strong password requirements and multi-factor authentication are used for administrative access. Remote access to DroneControl systems requires VPN and compliance with security standards on the connecting devices. We conduct periodic reviews of user access rights and monitor for unauthorized access attempts. User obligations: You must similarly manage access to your DroneControl account and any on-premise components. Limit access to authorized users, use strong passwords, and immediately revoke or update credentials when someone leaves your organization or no longer should have access. We recommend enabling any available multi-factor authentication for your accounts. You must notify DroneControl promptly if you suspect any compromise of your account or API keys.
9.2 Anti-Malware and Device Security: We employ industry-standard anti-malware protections on our systems. All DroneControl servers and devices run reputable anti-virus/anti-malware solutions with real-time scanning and daily definition updates. We maintain a Patch Management schedule to apply operating system and application updates regularly, closing vulnerabilities. We also train our staff to recognize and prevent malware threats. User obligations: You are responsible for securing your own devices that run DroneControl software (such as laptops, tablets, or the FirstResponder mobile device). You should install security updates timely and use anti-malware software. Do not use the Services on a compromised or unsafe device. If you discover or suspect that a file or data you uploaded to DroneControl is infected with malware, inform us immediately and refrain from further uploading until resolved.
9.3 Data Encryption: All sensitive data handled by DroneControl is encrypted in transit and at rest. Communications between clients (web browsers, mobile apps, drone controllers) and the DroneControl cloud are protected with TLS 1.2+ encryption (HTTPS/WSS), using strong ciphers (e.g. AES-256 GCM). We enforce HSTS (HTTP Strict Transport Security) on our web portals to prevent downgrade attacks and support perfect forward secrecy for TLS sessions. Internally, any data exchange between microservices or databases also occurs over encrypted channels or within secured VPC networks. For data at rest, DroneControl uses AES-256 encryption (server-side encryption) for all stored content (documents, photos, videos in S3 buckets). Our database and backups are encrypted as well. Encryption keys are managed via AWS Key Management Service with strict access controls (only the application’s roles can decrypt). These encryption measures align with industry standards (including FIPS 140-2 validated algorithms). User note: The end-to-end encryption of live video (WebRTC) means that even DroneControl cannot view your real-time footage unless a recording is initiated by you; live streams are decrypted only on authorized viewers’ devices.
9.4 Monitoring and Audits: DroneControl regularly audits its systems and processes to ensure compliance with our security policies and relevant regulations. We maintain logs of system access and have automated alerts for anomalous activities. For enterprise clients, we may offer the ability to audit certain aspects of our data processing (as outlined in the DPA). We also comply with external assessments and provide security questionnaires or documentation upon reasonable request (e.g. for government tenders, we share our White Paper and evidence of compliance to standards).
9.5 Incident and Breach Response: DroneControl has an Incident Response Team (IRT) and formal policies for managing security incidents and data breaches. Incident Reporting: If any DroneControl personnel or system detects a security incident (such as unauthorized access, malware outbreak, or data loss event), we will notify our IRT immediately. We classify and investigate all incidents promptly. If a Personal Data Breach (as defined by GDPR) occurs, DroneControl will inform affected clients without undue delay and within any timeframe required by law (e.g. within 72 hours as per GDPR, if applicable). We will provide you with relevant information about the nature of the breach, affected data, and any measures taken or recommended. Communication: DroneControl believes in transparent communication – we will notify customers and relevant stakeholders (which may include regulatory authorities and data subjects as necessary) of significant incidents in a timely manner. Post-Incident: After containment and recovery, DroneControl conducts a post-incident review to document lessons learned and improve our policies to prevent future occurrences. Regular drills and simulations are conducted to keep our team prepared. User obligations: If you become aware of any incident affecting the Services or your data (including any unauthorized use of your account or a suspected leak of personal data through the platform), you must promptly notify DroneControl. Your cooperation may be needed during incident investigations (for example, assisting with identifying impacted records or users). If a breach is jointly caused by your actions (or omissions) and DroneControl’s actions, we will work together in good faith to address the situation, each bearing responsibility to the extent of our respective fault.
9.6 Internal Policies and Enforcement: The security provisions described here are supported by DroneControl’s internal policies, including our Access Control Policy, Anti-Malware Policy, Data Incident Management Policy, and Data Protection Policy. Violations of these policies by DroneControl staff result in disciplinary actions up to termination. We expect similar diligence from Users: any User found to be deliberately compromising security (for instance, by attempting to hack the system or by recklessly mishandling data) may have their account terminated and potentially face legal consequences.
10. Third-Party Services and Hardware (DJI Integration)
10.1 Third-Party Services: The DroneControl Services may rely on or incorporate third-party services or libraries, such as mapping services (e.g. Mapbox, what3words), cloud infrastructure (AWS), communication services (WebRTC, Twilio), or analytics tools. These third-party services are not under DroneControl’s control, but we select reputable providers and contractually require them to meet high security and privacy standards. No Warranty for Third-Party Services: DroneControl makes no warranties regarding third-party services or content. Your use of those services may be subject to the third party’s terms of use and privacy policies. To the maximum extent permitted by law, DroneControl shall have no liability for any downtime, errors, or breaches attributable to third-party services, and your sole remedies will be with those third parties. For example, if an integrated map service fails to display a restricted zone and you violate airspace restrictions, DroneControl is not liable for that omission. We do not guarantee continuous availability of any third-party data (like airspace information), though we endeavour to provide reliable integrations.
10.2 DJI Hardware and MSDK Integration: Use of DJI Products: The Services are designed to work with DJI drone hardware (such as DJI Matrice or Mavic series drones) via the DJI Mobile SDK. By using DroneControl with a DJI drone, you also agree to comply with all applicable terms, guidelines, and warranties provided by DJI for that hardware. No DroneControl Warranty on Hardware: DroneControl does not manufacture drones or hardware and does not provide any warranty on the drones themselves. Any hardware defects or malfunctions are the responsibility of the manufacturer (DJI) or your hardware vendor, subject to their warranty terms. DJI Warranty Clarification: According to DJI’s official after-sales policy, failures or damage to DJI products caused by third-party software or accessories are not covered by DJI’s warranty. However, using DroneControl software (a third-party app) does not, by itself, void your DJI warranty. DJI will honor warranty claims for hardware issues as long as the drone has not been misused or physically modified, and as long as the issue is not directly caused by the third-party software. In other words, if your drone experiences a hardware failure that is not a result of DroneControl’s software, DJI’s warranty or DJI Care plan should still apply in the normal way. If a failure is directly caused by DroneControl’s software, that specific issue may not be covered by DJI’s warranty, but DroneControl will take responsibility as described below.
10.3 DroneControl’s Responsibility in DJI Integration: DroneControl has worked closely with DJI to ensure compatibility and compliance with DJI’s standards. We have confirmation from DJI that third-party apps built on their official SDK (like DroneControl) do not inherently void the warranty. In the unlikely event that DJI’s diagnostic process (using the encrypted .DAT flight logs) determines that a drone incident was caused by a DroneControl software malfunction, DroneControl will be liable under DJI’s warranty terms for that incident. Practically, this means DroneControl will collaborate with DJI to make the user whole: for example, if DJI would normally replace or repair a device under warranty but declines to do so because our software caused the issue, DroneControl will step in to resolve the issue consistent with DJI’s warranty/Care program. Cooperation: DroneControl will work in conjunction with DJI’s technical support to investigate any such incidents. We will use the flight logs to isolate the cause. If it’s determined to be a software-related issue on DroneControl’s side, DroneControl will provide a fix or remedy and coordinate with you and DJI for any repair/replacement needed. If it’s determined to be purely a hardware issue, then DJI’s standard warranty or service plan terms apply and DJI remains responsible. Summary: Using DroneControl with DJI drones should not void your warranty provided you use official hardware and SDK (which you are) and you have not made unauthorized modifications to the drone. DroneControl and DJI’s joint position is that hardware issues will be covered by DJI, and software-caused issues will be addressed by DroneControl in line with DJI policies.
10.4 No Endorsement: Reference to DJI or other third-party products within these Terms or the Services does not constitute an endorsement or guarantee by DroneControl of those products. Likewise, DJI’s acknowledgment of DroneControl (as an SDK developer) is not an endorsement of DroneControl by DJI. Both remain independent parties. You should ensure that any third-party hardware or service you use with DroneControl is used according to its documentation and limitations.
10.5 Third-Party Claims: You agree that DroneControl is not responsible for any third-party claims or disputes arising out of your use of third-party hardware or services in connection with DroneControl. For example, if a third party (including DJI) brings a claim against you for misuse of their product, that is between you and the third party. You agree to indemnify DroneControl against any such claims as set forth in Section 16.2.
11. Intellectual Property Rights
11.1 Ownership of DroneControl IP: All rights, title, and interest in and to the DroneControl Services, including the software, mobile app, web portal, algorithms, user interface design, features, databases, documentation, trademarks (DroneControl™), logos, and all intellectual property therein or associated therewith, are and shall remain the exclusive property of DroneControl and/or its licensors. The Services are protected by copyright, trade secret, and other intellectual property laws. No rights are granted to you under these Terms except as expressly set forth.
11.2 License to Use: Subject to your compliance with these Terms and timely payment of any applicable fees, DroneControl grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal operations and in accordance with the documentation. This license is provided for the sole purpose of enabling you to use and receive the benefit of the Services as intended by these Terms. You may not sub-license or assign this license to any third party. For organizational customers, your license is limited to the number of users or scope as agreed in your order or subscription; adding additional pilots or usage beyond that scope requires approval and possibly additional fees.
11.3 Restrictions: You shall not (and shall not allow any third party to) copy, modify, adapt, translate, or create derivative works of the Services or any software component. You shall not rent, lease, sell, assign, distribute, or otherwise transfer the Services or any of your rights herein to any third party, or provide time-sharing or similar services to any third party. No Reverse Engineering: You shall not reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying ideas or algorithms of any part of the Services, except to the limited extent allowed by mandatory law (and then only upon advance notice to us). No Removal of Notices: You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Services or output thereof.
11.4 User Content and Data: You retain ownership of all data, content, and media that you or your end users (pilots) upload or generate through the Services (such as flight logs, video footage, mission plans, or chat communications) – collectively, “User Content”. DroneControl does not claim ownership of your User Content. You hereby grant DroneControl a non-exclusive, worldwide, royalty-free license to process, transmit, store, and otherwise use your User Content for the purposes of providing the Services and as otherwise permitted by these Terms. This includes, for example, the right for us to copy your data to backup servers, to display video to your authorized viewers, or to use metadata from your flight logs to provide analytics to you. We will not use your User Content for marketing or unrelated purposes without your separate consent. You represent and warrant that you have all necessary rights in any User Content you input to the Services and that our processing of it in accordance with these Terms will not infringe or misappropriate any third-party rights.
11.5 Feedback: If you provide suggestions, ideas, enhancement requests, or other feedback to DroneControl regarding the Services (“Feedback”), DroneControl shall be free to use, disclose, reproduce, license, or otherwise distribute and exploit the Feedback as it sees fit, without obligation or restriction of any kind. Feedback is entirely voluntary and will not create any confidentiality obligation for DroneControl, even if you designate feedback as confidential.
11.6 Third-Party IP: The Services may include third-party software components that are subject to open-source licenses or other terms. To the extent required, DroneControl will provide a list of such components and their licenses. Your use of those components within the Services is subject to those third-party terms, which do not materially alter your usage of the platform. Also, any third-party trademarks, product names, or logos (such as “DJI”) that appear within the Services are the property of their respective owners; use of such marks is for identification and integration purposes and does not imply endorsement.
12. Data Retention and Deletion
12.1 Live Operational Data Retention: DroneControl retains live operational data (such as flight data, telemetry, and equipment data) only for as long as necessary to fulfill the purposes of the Services or as required by your contract or applicable law.. Other data (such as account information or required compliance records) may be stored for longer durations as needed under contractual or legal obligations. For instance, authentication logs may be retained for one year for security auditing, and basic account details are kept while your account remains active. If specific retention durations have been agreed in a Data Processing Contract or by law, DroneControl will adhere to those.
12.2 User Control and Deletion: You have the ability to delete certain data through the Services interface (for example, you might delete a saved mission plan or remove a video file). Deleting data via the interface will make it no longer accessible to you, but residual copies may persist in backups for a limited time. If you require deletion of personal data that is not self-service deletable, please send a deletion request to DroneControl support. We will delete or anonymize the requested personal data, unless we are required to retain it for legitimate business or legal purposes (in which case we will inform you). For organizational clients, if you (the Controller) request DroneControl (the Processor) to delete or return personal data at any time – or upon termination of Services – we will do so in compliance with Article 28 of GDPR (save any data we must keep by law). Upon termination of your account or contract, DroneControl will typically retain your data for a brief grace period in case the account needs to be reactivated or any issues resolved, then will proceed to permanently delete or anonymize your User Content and personal data. We may retain anonymized Aggregated Data (data stripped of personal identifiers) indefinitely for analytics and improvement purposes, as long as no individual is identifiable from that data.
12.3 Backup and Archive: DroneControl performs regular backups of critical data for disaster recovery. Backup data is encrypted and stored securely. These backups are cyclic and have a finite retention (e.g. a few weeks) after which they are overwritten. Thus, even after data is deleted from the live system, it may remain in encrypted backups until those backups expire. Backup data is only accessed if needed for restoration purposes. DroneControl may also retain certain records if necessary to establish, exercise, or defend legal claims (e.g. logs of system access in case of security investigations).
12.4 Legal Requirements: Notwithstanding the above, DroneControl may retain information if required to do so by law (for example, retention laws for communication data, or if we receive a preservation order related to legal proceedings). In such cases, DroneControl will securely store the data for the required period and isolate it from routine use.
12.5 User Export: Prior to termination or deletion of your account, you are encouraged to export any data you need to retain. DroneControl may provide export tools (e.g. downloading flight logs or exporting reports). It is your responsibility to retrieve your desired data before it is deleted. After data is deleted by DroneControl, it cannot be recovered.
13. Termination and Suspension
13.1 Termination by User: You may stop using the Services at any time. If you wish to terminate your account and these Terms, you can do so by providing written notice to DroneControl (or by using any account closure function in the platform, if available). If you are on a subscription or contract, termination may be subject to the terms of that subscription (for example, there may be no refund for early termination of a prepaid annual plan unless required by law or contract terms). Upon your termination of the Services, DroneControl will disable your account access. Sections of these Terms that by their nature should survive termination (such as indemnities, limitations of liability, etc.) will survive.
13.2 Termination or Suspension by DroneControl: DroneControl may suspend or terminate your access to the Services, in whole or in part, immediately by giving notice (which may be emailed) if: (a) you materially breach these Terms or repeatedly violate any provision (including non-payment of fees, if applicable, or violation of the Acceptable Use Policy in Section 4); (b) you are engaging in activity that, in our reasonable opinion, poses a security risk, may cause harm to our infrastructure or other users, or may subject us or others to liability; or (c) we are required to do so by law or a governmental order. In some cases of minor breach, we may provide you an opportunity to cure the breach if feasible; failure to cure in the time specified (if any) may result in termination. Additionally, we reserve the right to suspend the Services (in whole or part) on an emergency basis without prior notice if needed to address a serious security issue or to comply with law enforcement demands – we will inform you as soon as practicable in such cases.
13.3 Effect of Termination: Upon termination of your account for any reason, you must cease all use of the Services. Any licenses granted to you will terminate. You must delete any confidential information of DroneControl or software in your possession (for instance, if any offline components were provided, you should uninstall them). DroneControl will delete or anonymize your data as described in Section 12. If your account was part of an organization, the data may remain accessible to the organization’s administrator (if the organization continues to use the Services). Termination of the Services does not relieve you of any obligation to pay any outstanding fees, and no refunds will be issued for Services already rendered except at DroneControl’s discretion or as required by law.
13.4 Service Discontinuation: DroneControl reserves the right to discontinue the Services entirely (for all users) upon at least 60 days’ notice We will also provide data export assistance so you can transition away from the Service.
14. Disclaimer of Warranties
Use at Your Own Risk: The DroneControl Services are provided “as is” and “as available” to the maximum extent permitted by law. DroneControl and its affiliates, suppliers, and partners expressly disclaim any and all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not guarantee that the Services will meet your specific requirements, achieve any intended results, or operate uninterrupted or error-free. No Warranty of Accuracy: We make no warranty that information provided through the Services (such as maps, airspace data, or analytics) is comprehensive or error-free. No Warranty of Uptime: While we aim for high availability, we do not warrant that the Services will be available at all times or that they will be free from delays, downtimes, or disruptions. Scheduled maintenance or unforeseen outages may occur.
Disclaimer of Control: DroneControl does not control the operation of your drones; you are the operator. We provide tools and data, but the ultimate control and responsibility over any drone flight remain with you. We make no warranty that using the Services will prevent any accidents, incidents, or legal issues. You acknowledge that drone operations carry risks (including crashes, injuries, property damage, regulatory penalties) and that you use DroneControl as one tool to assist you, not as a substitute for prudent and lawful piloting.
Third-Party Materials: Any third-party software, services, or hardware is provided “AS IS” without any warranty of any kind from DroneControl. DroneControl disclaims any liability for the actions or omissions of third-party providers or the manufacturers of your equipment.
No Oral or Written Information: No advice or information (oral or written) obtained from DroneControl or through the Services shall create any warranty not expressly stated in these Terms. You acknowledge that DroneControl is not making any guarantees of results or outcomes from the use of the platform (for example, we do not guarantee that using DroneControl will cause your emergency response operations to always succeed or be free of mistakes).
Consumer Law: If you are using the Services as a consumer (not as part of a business), you may have certain rights under your local laws that cannot be disclaimed. In such cases, the above disclaimers shall apply to the fullest extent permitted by such laws, but this clause is not intended to deprive you of any mandatory protections.
15. Limitation of Liability
15.1 Indirect Damages: To the fullest extent permitted by law, in no event will DroneControl or its directors, officers, employees, agents, or affiliates be liable to you or any third party for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of (or inability to use) the Services. This includes, without limitation, damages for lost profits or revenues, loss of data, loss of goodwill, business interruption, procurement of substitute services, or other intangible losses, even if DroneControl has been advised of the possibility of such damages. DroneControl will not be liable for any damages caused by your failure to perform your responsibilities under these Terms, or for any damage caused by your drone hardware or third-party products (including any crashes or malfunctions of drones).
15.2 Liability Cap: To the fullest extent permitted by law, DroneControl’s total cumulative liability arising from or related to the Services (whether in contract, warranty, tort – including negligence –, product liability, or any other legal theory) shall not exceed the amount actually paid by you (if any) to DroneControl for the Services in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not made any payment (for example, if you are using a free version or trial), DroneControl’s liability shall not exceed CHF 100 (or equivalent in local currency). This limitation is cumulative and not per-incident; multiple claims will not expand the cap.
15.3 Exceptions: The limitations and exclusions of liability in this Section 15 shall not apply to the extent prohibited by applicable law. In certain jurisdictions, liability cannot be limited for death or personal injury caused by negligence, for gross negligence or willful misconduct, or for fraud. Also, some jurisdictions do not allow the exclusion of certain warranties or the limitation/exclusion of certain damages. In such cases, portions of these limitations may not apply to you. However, in such circumstances, the parties agree that the limitations of liability set forth herein shall be enforced to the greatest extent permissible, and that the allocation of risk in these Terms is an essential basis of the bargain between the parties.
15.4 Allocation of Risk: You acknowledge that DroneControl has offered its Services and set its prices (if applicable) in reliance on the disclaimers of warranty and the limitations of liability set forth in these Terms, and that these provisions allocate risk between the parties and form an essential part of the agreement. Absent these provisions, the terms and conditions of use would be substantially different. You also acknowledge that ensuring appropriate insurance coverage for your operations (as described in Section 6) is a key part of managing your own risk, and that DroneControl’s liability is limited accordingly.
15.5 No Liability for Regulatory Penalties: DroneControl shall not be liable for any fines, penalties, or enforcement actions taken against you by regulators or authorities as a result of your drone operations. Compliance features in the platform are offered to help you, but responsibility for obeying the law is solely yours (see Section 5.1). For example, if you violate airspace restrictions or data protection laws in your usage of drones, any resulting penalties are your responsibility, even if DroneControl’s tools were used or misused in the process.
15.6 Release: To the extent permissible by law, you release DroneControl from any and all liability or obligations not expressly assumed in these Terms. If you are a California resident, you waive California Civil Code §1542 (which otherwise says a general release does not extend to claims unknown to the creditor) and any similar law in other jurisdictions, meaning that you also release DroneControl from claims you do not know or suspect to exist in your favor at the time of agreeing to this release.
16. Indemnification
16.1 Indemnification by User: You agree to defend, indemnify, and hold harmless DroneControl and its officers, directors, employees, agents, affiliates, and licensors (“Indemnified Parties”) from and against any and all third-party claims, actions, suits, or proceedings, as well as any losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or accruing from: (a) your use of the Services in violation of these Terms or applicable law; (b) your drone operations (except to the extent caused by DroneControl’s breach or negligence), including any property damage, personal injury, or death caused by you or your drone; (c) your violation of any intellectual property, privacy, or other rights of a third party through your use of the Services or User Content (for example, capturing footage in violation of privacy rights, or using unlicensed maps); or (d) any breach by you of Section 5 (User Responsibilities) or Section 6 (Insurance) of these Terms (including any failure to have required insurance, which leads to DroneControl being pursued by third parties for damages). DroneControl reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations), in which event you agree to cooperate with our defense of such claim.
16.2 Indemnification by DroneControl: DroneControl will indemnify and hold you (and your officers, directors, and employees) harmless from any third-party claims and liabilities to the extent arising from an allegation that the DroneControl platform, as provided and when used in accordance with these Terms, infringes a third party’s patent, copyright, or trademark, or misappropriates a third party’s trade secret. This indemnity is subject to you: (a) promptly notifying DroneControl of the claim (to avoid prejudice to our defense); (b) giving DroneControl sole control of the defense and settlement of the claim; and (c) providing cooperation and assistance as reasonably requested. If the Services are found or believed by DroneControl to infringe, DroneControl may choose to: (i) modify the Services so that they are non-infringing; (ii) obtain a license for your continued use of the Services; or (iii) if neither (i) nor (ii) is commercially feasible, terminate your use of the Services and refund any prepaid, unused fees. DroneControl’s obligations under this section will not apply to claims based on: (y) any combination of the Services with products or services not provided by DroneControl; or (z) any use of the Services in a manner contrary to these Terms or the documentation. This Section states DroneControl’s sole liability and your exclusive remedy for intellectual property infringement claims regarding the Services.
17. Governing Law and Dispute Resolution
17.1 Governing Law: These Terms and any disputes arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of laws principles. However, if you are using the Services as a consumer in a jurisdiction with mandatory consumer protection laws, nothing in this clause shall deprive you of the protection of those mandatory provisions of law.
17.2 Jurisdiction: The parties agree that any dispute or claim arising out of or relating to these Terms or the Services that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Geneva, Switzerland, except that DroneControl may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent misuse of its intellectual property or Confidential Information.
17.3 Dispute Resolution and Arbitration: In the interest of resolving disputes in a cost-effective and time-efficient manner, the parties agree to attempt to resolve any dispute informally first. You should contact DroneControl at info@dronecontrol.co to discuss any issue. If we are unable to resolve a dispute within 30 days through negotiations, either party may seek to resolve the dispute through binding arbitration or litigation as set forth above. [Optional: If both parties agree, a dispute may be finally resolved by arbitration under the ICC International Court of Arbitration rules, with one arbitrator appointed, and the seat of arbitration in Geneva, conducting proceedings in English. However, neither party can be compelled to arbitrate without such mutual agreement.]
17.4 Class Action Waiver: To the extent permissible by law, all disputes shall be resolved on an individual basis. You agree not to bring or participate in any class, collective, or representative action against DroneControl. If this class action waiver is found unenforceable, then any class action may only be brought in a court of competent jurisdiction and not in arbitration.
17.5 Government Users: If you are a government or public sector entity and your law mandates certain dispute resolution forums or governing law, please contact us to discuss an amendment to this Section. We recognize that, for example, U.S. federal agencies cannot be bound by foreign law or arbitration without authorization. Our goal is to find a mutually acceptable solution in such cases.
18. Miscellaneous Provisions
18.1 Entire Agreement: These Terms (including any documents incorporated by reference, such as a Data Processing Contract or Privacy Policy, and any order forms or addenda executed between you and DroneControl) constitute the entire agreement between you and DroneControl regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter. In the event of a conflict between these Terms and any DPA or custom agreement with a customer, the conflict will be resolved in favor of the document specifically negotiated (e.g. the DPA for data protection matters, or a signed contract, over this general form).
18.2 Amendments: DroneControl may update or modify these Terms from time to time. We will provide notice of material changes (e.g. via email or in-app notification) and update the “Effective Date” at the top. Your continued use of the Services after updated Terms have been posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Services. Any changes will not apply retroactively to disputes or events occurring before the changes take effect, except as required by law.
18.3 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court or tribunal, that provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect. The parties will negotiate in good faith a valid and enforceable provision that most nearly effects the original intent of the unenforceable provision.
18.4 Waiver: No failure or delay by either party in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy. A waiver on one occasion shall not be deemed a waiver of any other right or remedy on any other occasion. To be binding, any waiver of any provision of these Terms must be in writing and signed by an authorized representative of the waiving party.
18.5 Force Majeure: Neither party shall be liable for any failure or delay in performance of its obligations (except payment obligations) if such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, terrorism or war, civil disturbance, governmental action, power or Internet outages, or other force majeure events. The affected party shall notify the other of the situation and make reasonable efforts to resume performance as soon as possible.
18.6 Assignment: You may not assign or transfer these Terms or any rights or obligations hereunder, whether by contract, operation of law, or otherwise, without DroneControl’s prior written consent. Any attempted assignment in violation of the foregoing shall be null and void. DroneControl may assign or transfer these Terms or any rights or obligations, in whole or part, without your consent to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
18.7 No Agency: These Terms do not create any joint venture, partnership, employment, or agency relationship between you and DroneControl. Neither party has authority to bind the other or act on the other’s behalf without express written consent.
18.8 Notices: DroneControl may provide notices to you by email to the address associated with your account, via in-service notifications, or by written communication sent by first class mail to your address on record. You must direct notices to DroneControl in writing by email to info@dronecontrol.co or by postal mail to our registered address provided above. Notices shall be deemed given (a) if by email, when the email is sent (provided no bounce-back or error is received); (b) if by in-app or web notification, upon your logging in and viewing the notice (or 24 hours after it is posted, whichever is sooner); or (c) if by mail, upon delivery by the postal service or courier.
18.9 Language: These Terms are written in English. If we provide a translation, it is for convenience only. In the event of any conflict between the English version and a translated version, the English version shall control. All communications and dispute resolution proceedings shall be conducted in English, unless otherwise required by law.

By agreeing to these Terms and using the DroneControl Services, you acknowledge that you have read and understood these Terms, and you agree to be bound by all of the above provisions. You further acknowledge that you have independently evaluated the suitability of the Services for your purposes and have not relied on any representation or warranty not expressly set forth in these Terms. These Terms form a binding legal agreement between you and DroneControl.
